SMS TERMS & CONDITIONS

These SMS/Text Messaging Terms & Conditions ("Terms") govern the SMS messaging services provided by Redinbaugh Enterprises, LLC dba Acuhawk Insurance Solutions ("Acuhawk"). By opting in to receive SMS messages, you expressly consent to the collection, use, and disclosure of your personal information as described in these Terms and Acuhawk’s Privacy Policy.

1. Consent to Receive SMS Messages

By providing your mobile number and opting in, you consent to receive informational and marketing text messages from Acuhawk, including but not limited to policy updates, promotional offers, reminders, and account notifications. Messages may be sent using an automatic telephone dialing system ("Auto dialer") or other automated technology.

2. Opting In

You may opt-in to receive text messages through any of the following methods:

• Completing the SMS/Text Messaging Opt-In Form

• Selecting the opt-in checkbox on Acuhawk’s website contact form

• Verbally authorizing a representative of Acuhawk

• Sending "SUBSCRIBE" to Acuhawk’s designated number

Upon subscribing, you will receive a confirmation text message. Your consent to receive SMS messages is not a condition of purchasing any goods or services from Acuhawk.

3. Opting Out

You may opt-out of receiving SMS messages at any time by replying "STOP" to any Acuhawk text message. Upon receipt of your opt-out request, you will receive one final confirmation message.

4. Description of SMS Program

The Acuhawk SMS Program provides text messages related to account activity, product updates, services, and promotions. No insurance coverage may be bound, altered, or modified through SMS messaging.

5. Message Frequency & Charges

The frequency of messages may vary based on your account activity and interactions. While Acuhawk does not charge for SMS messages, standard message and data rates may apply. Contact your mobile carrier for details regarding your messaging plan.

6. Service Availability & Supported Carriers

The Acuhawk SMS Program is supported by most major mobile carriers. However, Acuhawk is not responsible for delays or message failures caused by transmission issues beyond its control, including network outages or carrier limitations.

7. Mobile Number Ownership & Responsibility

By opting in, you represent that you are the authorized user of the provided mobile number. If you change or deactivate your number, you must update Acuhawk to avoid misdirected messages. You agree to indemnify Acuhawk for any claims arising from your failure to notify Acuhawk of a number change.

8. Privacy Policy

Your personal information will be processed in accordance with Acuhawk’s Privacy Policy, available here. Acuhawk does not sell or share your mobile number with third parties for marketing purposes.

9. Eligibility

Participation in the Acuhawk SMS Program is limited to U.S. residents who are 18 years of age or older and authorized to enroll a mobile number in the program.

10. Modifications to These Terms

Acuhawk reserves the right to update or modify these Terms at any time. Updates will be posted on our website, and continued participation in the SMS Program constitutes acceptance of the revised terms.

11. Termination of SMS Messaging Services

Acuhawk may suspend or terminate SMS messaging services at its discretion, including in cases of suspected misuse or non-compliance with these Terms.

12. Disclaimer of Warranties & Limitation of Liability

The Acuhawk SMS Program is provided "as is" and without warranties of any kind. Acuhawk shall not be liable for any indirect, incidental, or consequential damages arising from participation in the SMS Program.

13. Dispute Resolution & Arbitration Agreement

All disputes related to SMS messaging shall be resolved exclusively through binding arbitration under the American Arbitration Association’s Consumer Arbitration Rules. Claims must be brought individually and not as part of a class action or representative proceeding.

14. Attorney Fees

If Acuhawk prevails in any dispute arising from these Terms, it is entitled to recover reasonable attorneys’ fees and associated costs.

15. Acceptance of Terms

By opting into Acuhawk’s SMS Program, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
